Terms of Service - Deeprest

1. Description of Service

Deeprest ("the App") is a white noise and ambient sound application that provides various colored noise types (brown noise, pink noise, white noise, green noise) and environmental soundscapes to help users sleep, focus, and relax. The App is developed and operated by StellarByte Technologies Inc. ("we", "us", or "our").

By using the App, you agree to these Terms of Service. If you do not agree to these terms, please discontinue use of the App.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on your personal device for personal, non-commercial purposes only.

You may not:

Copy, modify, distribute, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove or alter any copyright notices or labels in the App
Use the App for any unlawful purpose
Use any part of the App for commercial purposes without our prior written consent

3. Free and Premium Content

Free Content

The App provides the full sound library for free use, including all noise types and ambient sounds. The App does not contain advertisements.

The current version (v1) does not offer in-app purchases or subscriptions.

4. Intellectual Property

App Content

The design, code, icons, UI elements, and overall visual presentation of the App are the intellectual property of StellarByte Technologies Inc. and are protected by copyright law.

Audio Assets

Audio assets used in the App are licensed under CC0 (Creative Commons Zero) or are in the public domain, and are legally used for commercial purposes.

Third-Party Components

Open-source components used in the App are subject to their respective open-source licenses.

5. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

The App does not constitute medical advice. If you have sleep disorders or health concerns, please consult a qualified healthcare professional.
We do not guarantee that the App will meet your specific requirements or achieve any particular results.
We do not warrant that the operation of the App will be uninterrupted or error-free.
IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Volume Safety Notice: When using headphones or earphones for extended periods, please maintain a safe listening volume to prevent hearing damage.

6. Children's Use

The App is not directed at children under the age of 13. Users under 13 should use the App only with the supervision and consent of a parent or legal guardian.

If we become aware that we have collected information from a child without parental consent, we will promptly delete such data.

7. Service Changes and Termination

We reserve the right to:

Modify, suspend, or discontinue any part or all of the App's features at any time
Update, upgrade, or change the App's content and design
Restrict or terminate your access to the App in the event of a violation of these terms

We will make reasonable efforts to provide advance notice of significant changes but are under no obligation to do so.

8. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of any changes by posting the updated terms within the App and revising the "Effective Date." Your continued use of the App after such changes constitutes acceptance of the revised terms.

Material changes will be communicated through in-app notifications.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada. Any disputes arising from these terms shall first be resolved through good-faith negotiation; failing which, the dispute shall be submitted to the courts of competent jurisdiction in British Columbia.
